Acceptance of THRU™ Terms and Conditions

These THRU™ Terms and Conditions are entered into by and between you and TriBike Transport, LLC d/b/a THRU Sport ("THRU Sport" or “our”). The following terms and conditions, together with any documents expressly incorporated herein by reference (collectively, "Terms and Conditions"), govern your use of our THRU Sport shipping service.


Please read the Terms and Conditions carefully before you start to use the THRU Sport shipping service. By using the THRU Sport shipping service or by clicking to accept or agree to the Terms and Conditions when this option is made available to you, you accept and agree to be bound and abide by these Terms and Conditions. If you do not want to agree to these Terms and Conditions, you must not use the THRU Sport shipping service.


The THRU Sport shipping service is offered and available to users who are 18 years of age or older. By using the THRU Sport shipping service, you represent and warrant that you are of legal age to form a binding contract with THRU Sport and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not use the THRU Sport shipping service.



Changes to Terms and Conditions

THRU Sport may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when THRU Sport posts them. However, any changes to the dispute resolution provisions set out in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice before the date the change is posted on our website.


Your continued use of the THRU Sport shipping service following the posting of revised Terms and Conditions means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.



General Shipping Policy

Use of the THRU Sport™ shipping service is for bicycles, bicycle components and parts, and bicycle gear only (collectively, “Bicycle Equipment”). Any use or attempted use of shipping services for items other than Bicycle Equipment is explicitly prohibited. Failure to abide by this policy may result in fines, additional fees or other surcharges, suspension of your shipping account/privileges, or other consequences as determined by TriBike Transport, LLC d/b/a THRU Sport (“THRU Sport”).


THRU Sport is not liable for delays, refusals, loss, or damage of any shipment containing prohibited items. Any additional costs, fines, or penalties levied upon THRU Sport by a third party carrier, or any local, state, or federal government as a result of shipping prohibited items will be passed on to you, the consumer, and will be solely your responsibility.


When you purchase a shipping label via THRU Sport, you agree to our Terms and Conditions as described herein, which may be amended from time to time, as well as the terms and conditions of any of our partner carriers. The FedEx terms of use can be found here.


Shipping Conditions and Packing Requirements

Under ordinary circumstances, it is normal for your Bicycle Equipment to be subject to any or all of the following conditions during the shipping process:

●     Extreme temperatures (both high and low)

●     Drops from up to waist height

●     Vibrations consistent with air travel through turbulent skies, or truck travel on rough roads

●     Contact with other packages, truck shelves, conveyor belts, and other items

●     Changes in orientation and being at the bottom of a stack of smaller packages


In order to ensure the safety of your Bicycle Equipment under these conditions, proper packing is required. For more detailed information on the best method to pack your Bicycle Equipment, please follow our HOW TO GUIDE, or contact us with any questions or concerns prior to shipping. Be sure that you also follow THRU Sport’s labeling guidelines for affixing your label to your box or case.


Thus, when you ship your Bicycle Equipment with THRU Sport, you acknowledge that your Bicycle Equipment will be subject to ordinary shipping conditions, and you acknowledge and agree that to follow proper packing and labeling procedures to protect it from such conditions.


Dimensions and Weight

You are required to accurately measure and enter information regarding the dimensions and weight of any shipments sent via THRU Sport’s shipping service. Entering inaccurate dimensions and/or weight may cause your shipment to be halted, delayed, or returned. In addition, you may incur additional fines or surcharges, or your account may be suspended for falsifying shipment information.


When measuring dimensions, use a tape measure, and always round any measurements up to the next whole unit. E.g. your box measures 10 ½ inches in width, you would enter the width as 11 inches. If your box or case is not rectangular (i.e. the width, or height varies), always use the measurement of the longest or widest side.


When measuring weight, use an accurate scale, and always round any measurements up to the nearest whole number. E.g. your box weighs 27.2 lbs., you would enter the weight as 28 lbs.


Every shipment sent via THRU Sport’s shipping service is audited to screen for inaccurate dimensions or weight, and any user who enters inaccurate or fraudulent information will be charged the difference in shipping costs, plus a penalty of $50 per shipment. In addition, any packages that are deemed oversized by a third-party carrier (those that are over 108 inches in length, over 165 inches in length plus girth, or weigh more than 150 lbs.), will be subject to an oversize fee of $800. You acknowledge and agree that these third-party carrier dimensions and weight limits for oversized packages are subject to change without prior notice.


Any user who enters inaccurate dimensions or weight for their shipment will have the right to show proof that the information entered was accurate at the time of shipping. THRU Sport, in its sole discretion, reserves the right to suspend repeat offenders of this policy.


Protection Plans

Each shipment order placed with THRU Sport comes with a $100 of loss/damage standard protection included. Premium protection plans of up to $15,000 per shipment order can be purchased at the time the order is placed. Premium protection plan claims will be paid only if the Bicycle Equipment was properly packed and these Terms and Conditions were followed. The standard and premium protection plans do not apply to the box, packaging, or case itself, only the contents.


The standard and premium protection plans are NOT an insurance policy, and THRU Sport is not an insurance company. The premium protection plan is an optional service and is not required in order to ship Bicycle Equipment via THRU Sport. Exposure and risk of any losses in excess of the purchased value of the premium protection plan is assumed solely by the user. If you so choose, you may insure your shipment through third-party insurance company of your choice with an insurance policy. You are responsible for the cost of, and claim process for, any such policies with the insurance company.


If the damage or loss is solely caused by circumstances beyond ordinary shipping conditions while in possession of our partner carriers, the standard and premium protection plans will cover the lesser of either the repair or replacement cost of properly packed goods, up to the value declared (and not to exceed the market value of said goods). Ordinary shipping conditions include, but are not limited to:


●     Extreme temperatures (both high and low)

●     Drops from up to waist height

●     Vibrations consistent with air travel through turbulent skies, or truck travel on rough roads

●     Contact with other packages, truck shelves, conveyor belts, and other items

●     Changes in orientation and being at the bottom of a stack of smaller packages


The premium protection plan does not cover pre-existing defects or conditions, goods that go missing, or are stolen after delivery is made. Any shipment sent via THRU Sport with a declared value of $500 or more under a premium protection plan will be delivered with a signature required.


The value declared through the premium protection plan cannot exceed the market value of the goods being shipped. The actual market value of the goods in your shipment is subject to adjustment by THRU Sport in its sole discretion. Should THRU Sport determine the actual market value is lower than the declared value, THRU Sport reserves the right to provide coverage at the lower determined actual market value. THRU Sport's maximum liability for any accidental damage or loss (subject to all the requirements set forth herein) is the LESSER OF: the declared value you select at the time of shipping, and the actual market value of the shipment.


You are responsible for accurately entering the declared value amount at the time of shipment. No changes or additions of any kind can be made to the declared value or premium protection plan amount (except by THRU Sport as set forth above) after a shipment is tendered to the carrier.


The premium protection plan will not cover damage or loss to Bicycle Equipment that was not packed in accordance with THRU Sport’s packing and labeling guidelines. A valid claim requires you to provide proof that proper packing and labeling guidelines were followed prior to tendering the package to the carrier. The below list explains procedures that are required to meet THRU Sport packing and labeling guidelines. Failure to follow and document these items will result in denial of loss/damage claims:


  1. Claims of damage to your bike frame, including paint scratches, dents, or punctures, will be denied unless:
  2. You wrapped the entire frame in thick foam padding.
  3. Your frame and all other items were secured inside your box/case to prevent contact between the frame, other contents, and the box/case itself.
  4. Claims of damage to your wheels, hubs, or rims; or any damage caused by the wheels, hubs or rims, will be denied unless:
  5. Each of your wheels were placed inside a wheel bag (one wheel per bag, with no other items including skewers, loose cassettes, etc.); OR
  6. Each wheel was protected with a plastic end cap on both sides of the hub, then wrapped in thick padding equal to the amount of protection provided by a wheel bag.
  7. Full disc wheels (full carbon, disc covers, or faring based full disc wheels) must be shipped separately from your bike in their own box or case. Any claims of damage to full disc wheels that were shipped in the same box as a bike, or other wheels or components will be denied.
  8. Claims for damage to the front or rear dropouts, the frame, or fork will be denied unless:
  9. Spacers, spare hubs, or spare axles were installed in the front fork, and rear dropouts and secured in place.
  10. Claims for damage to the rear derailleur or rear derailleur hanger will be denied unless:
  11. The rear derailleur was removed from the hanger, wrapped in padding, and secured to the frame.
  12. The derailleur hanger was padded after removing the rear derailleur.
  13. Claims for damage to the handlebars, brake levers, or shift levers will be denied unless:
  14. The handlebars, brake levers, and/or shift levers as well as all nearby components (such as the stem, top tube and fork) were wrapped in foam padding.
  15. The handlebars were secured to the frame, with the levers facing inwards, towards the bike frame, and not towards the sides of the box/case.
  16. Claims for damage to the chainrings, cranks, or bottom bracket will be denied unless:
  17. Padding was installed under the chainrings or bottom bracket to prevent the chainrings or bottom bracket from contacting the bottom of the box/case.
  18. This applies to bikes with fairings, or brakes that sit under the bottom bracket as well. Padding, or a foam block, must be placed between the bottom of the box, and these components.
  19. Any other claims of loss or damage will be denied unless:
  20. The box used for shipping was new, or if reused, is still in like new condition.
  21. The case chosen for shipping was specifically designed for shipping of Bicycle Equipment.
  22. The shipping label was secured to the box/case following THRU Sport Labeling Guidelines.
  23. A second copy of the shipping label was placed inside the box/case.


By shipping your Bicycle Equipment with THRU Sport, you acknowledge and agree that if you do not follow THRU Sport packing and labeling guidelines, you will forfeit any benefit under the standard and/or premium protection plan.


Claims of Loss or Damage

THRU Sport’s premium protection plan provides protection from loss or damage when your shipment is in the possession of our partner carriers. Should your shipment be lost or damaged accidentally by one of our partner carriers, please contact THRU Sport, and not the carrier, to begin the claims process.


Any claims submitted under THRU Sport’s premium protection plan will be reviewed and considered on a case-by-case basis. During the claims process, THRU Sport will determine whether the claimed loss or damage is repairable or requires replacement. The premium protection plan will cover the actual cost of repairing or replacing the good with a comparable replacement (make, model year, item function, etc.) up to the lesser of: the declared value you select at the time of shipping, and the actual market value of the damaged item or component, as determined by THRU Sport. The valuation of all items is subject to depreciation.


All claims must be submitted to THRU Sport in writing or via email within ten (10) days of delivery of your shipment. Claims must be accompanied by written and photographic documentation including, but not limited to, all of the following:


●     A written description of any and all damage to the Bicycle Equipment.

●     A written description of the damaged items themselves, including make, model, year, and/or serial numbers.

●     Photos of the damage to the Bicycle Equipment.

●     Photos of damage to the box/case and or packing materials.

●     Photos that document proper packing and labeling procedures were followed, as well as the entire bike.

●     Proof of value/purchase price for damaged Bicycle Equipment.

●     Proof of repair/replacement costs (can be in the form of an estimate or invoice).


All supporting documentation must be submitted to THRU Sport within thirty (30) days of the date the initial claim is filed by you with THRU Sport. Failure to provide all requested information within these timeframes will result in denial of the claim.


Only one claim may be filed per shipment. By accepting payment or settlement for a claim, you forfeit any and all rights to file any additional claims on the same shipment. Under THRU Sport’s premium protection plan, the maximum declared value per package, and thus the maximum amount that can be paid for any one claim is $15,000 USD.


THRU Sport reserves the right to inspect any damaged items including, but not limited to, bicycle frames, components, or other goods, either via physical inspection on site at the recipient’s premises, or by having the items shipped to a destination of THRU Sport’s choosing. Any items shipped for physical inspection will be sent under the same terms and conditions of the original shipment, including any declared value. THRU Sport will cover the additional reasonable costs of shipping an item for inspection. Any items used in the initial shipment, including boxes, cases, packing materials, and shipping labels should be kept, and must be made available for inspection, when requested.


THRU Sport will not be held responsible for the loss or damage of any goods that violate our Terms and Conditions, including any shipping of prohibited items, including, but not limited to any of the following:


●     Antiques or collectibles such as trading cards, stamps, or coins

●     Artwork, photographs, paintings, or posters

●     Auto Parts

●     Cash, currency, or any cash equivalent such as money orders, cashier’s checks, coupons, gift cards, or gift certificates.

●     Electronics not directly associated with or used for bicycles or biking activities. Exceptions would be cycling computers, or integrated power meters.

●     Jewelry of any kind.

●     Musical instruments.

●     Precious metals or gemstones.


Any shipment containing the above-mentioned items should not be shipped using THRU Sport’s shipping service. Shipping any prohibited items, including, but not limited to, the aforementioned items will void your standard or premium protection plan. THRU Sport will accept no liability for any loss or damage to any of the aforementioned items, or any other prohibited items shipped via THRU Sport’s service.


THRU Sport accepts no liability, or obligation of any kind to pay any claim that is denied for any of the aforementioned reasons, or any violation of THRU Sport’s shipping policies or our Terms and Conditions.


Disclaimer of Warranties

Thru sport makes no warranty whatsoever with respect to its shipping services, including any (a) warranty of merchantability; or (b) warranty of fitness for particular purpose; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise


Limitation of Liability

To the fullest extent provided by law, in no event will thru sport, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the thru sport shipping service, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

Our total liability under these terms and conditions, and the standard and premium protection plans relating to all claims that you make pursuant to these terms and conditions, or the standard or premium protection plans shall not exceed the actual market value of the bicycle equipment, as determined by thru sport in its sole discretion.

Governing Law and Jurisdiction

All matters relating to the THRU Sport shipping service and these Terms and Conditions, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of North Carolina without giving effect to any choice or conflict of law provision or rule (whether of the State of North Carolina or any other jurisdiction).


Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the THRU Sport shipping service shall be instituted exclusively in the federal courts of the United States or the courts of the State of North Carolina, in each case located in the City of Asheville and County of Buncombe. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.


The THRU Promise

If your Bicycle Equipment does not arrive on the scheduled delivery date (based on the shipping and transit time quoted) using THRU Sport’s shipping service, you will be refunded the shipping costs for that specific label, minus any amount paid for the premium protection plan, as long as these Terms and Conditions were followed.


When transit times are quoted, the day a package is dropped off or picked up by the third-party carrier does not count as a “day in transit”, nor do weekend dates or holidays. For example, if a shipment is quoted to take 3 days, and is dropped off or picked up on Friday the 1st, it would be scheduled to arrive on Wednesday the 6th.


If you ship your bike for a specific trip, vacation, race, training camp, or other time sensitive event, and it is not delivered on time, THRU Sport will help by renting you a bike until your bike is delivered. You will be responsible for the initial payment for the rental and will be reimbursed up to $100 per day ($600 maximum for the entire length of the rental). Written proof of cost via a receipt or invoice is required for reimbursement.


The THRU Promise does not apply in situations where:

●     Your bike is not picked up or dropped off as scheduled.

●     The delivery is attempted on schedule, but refused, or unsuccessful for any reason outside the partner carrier’s control. This includes if the delivery address requires a correction after the shipment is tendered.

●     The shipping label was not affixed to the box/case following THRU Sport guidelines, or if a second label was not placed inside the box/case, causing a delay in delivery.

●     Your bike is delayed due to insufficient packaging or shipping of a prohibited item.

●     There is a disruption with our partner carrier, in their sole discretion:

      ○      Including if your bike is shipped during a period of no delivery guarantees, which often happens around the holidays.

      ○      There is a service interruption caused by natural disasters, weather, acts of war, terrorism, acts of god, pandemics or other serious communicable illness, or states of emergency.

Any requests for refunds/reimbursement via the THRU Promise program must be submitted within 10 days of the scheduled delivery date.


Reroute and Return to Sender Policy and Costs

THRU Sport will do everything possible to accommodate any reroutes or changes in delivery addresses after a package has been shipped. There is no guarantee that a reroute or change of service is possible, and any changes, address updates, reroutes, returns, or expediting of any shipment are at the sole discretion of the partner carrier.


If a shipment requires a minor change in address (within the same City and State), you will be charged a fee of $20. If a shipment requires a change in address to a different City and State, you will be charged a fee of $20, plus any additional charges, fees, or costs levied by the partner carrier. If a shipment requires a return to the original address (i.e. “return to sender”), you will be charged a charge fee of $20, plus any additional charges, fees, or costs levied by the partner carrier.


Any reroute or return shipping costs are your responsibility. You acknowledge and agree that these charges may be applied to the original form of payment used when creating the shipment.


Refund Policy

THRU Sport offers full refunds, minus payment processing fees, on any unused shipments up to 75 days after the initial purchase date. Any shipment purchased greater than 75 days ago is non-refundable.


Refunds will be processed back to the original payment method used to create the shipment. Refunds issued to a credit or bank card may take up to 7-10 business days to process.


Entire Agreement

The Terms and Conditions, and any exhibits, schedules, or other documents incorporated herein by reference, constitute the sole and entire agreement between you and THRU Sport regarding the THRU Sport shipping service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the THRU Sport shipping service.
